Introduction

This PRIVACY POLICY (“Privacy Policy”) governs the privacy terms for GhostWrite, as owned and operated Lydian AI LLC (“Lydian AI”). “You” or “Your” refer to you as a user of GhostWrite. This Privacy Policy is part of the GhostWrite License Agreement and Terms of Use (this “Agreement”), that can be read here: https://ghostwrite.rip/terms-conditions.

Lydian AI has adopted and published this Privacy Policy in order for You to understand the process of collecting Your Non-Personal Information and Personally Identifiable Information and Lydian AI’s use of information collected.

Definitions

"Non-Personal Information" is information that is not personally identifiable to You and that Lydian AI automatically collects when You access or use GhostWrite, and may include information such as IP addresses, domain servers, web browser, web browser version, referring URL, device type, device operating agreement, traffic and usage data.

"Personally Identifiable Information" is non-public information that is personally identifiable to You and obtained from You in, from, or through GhostWrite or otherwise. Personally Identifiable Information may include information such as Your name, email address, phone number, address, purchase and subscription history and plans, payment information, any communication with Lydian AI customer service, Your input into GhostWrite, and Your user behavior in response to the emails generated by GhostWrite including whether You send, delete, or edit any GhostWrite written email, along with any other personal information that You provide to Lydian AI or that Lydian AI obtains about You. Any information that is publicly available, deidentified, or aggregated with other user information is not Personally Identifiable Information.

Overview and Guiding Principles

Lydian AI’s Privacy Policy follows these principles:

Before or at the time of collecting Your Personally Identifiable Information, Lydian AI will identify the purposes for which information is being collected, in this Privacy Policy or elsewhere.
Lydian AI will collect and use Personally Identifiable Information solely with the objective of fulfilling those purposes specified by Lydian AI and for other compatible purposes, unless Lydian AI obtains Your consent or as required by law.
Lydian AI will only retain Your Personally Identifiable Information as long as necessary for the fulfillment of those purposes.
Lydian AI will collect Your Personally Identifiable Information by lawful and fair means and, where appropriate, with Your knowledge or consent, including any consent you provide in this Agreement.
Personally Identifiable Information should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
Lydian AI will protect Personally Identifiable Information with reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification.
Lydian AI will make readily available to You information about its policies and practices relating to the management of Personally Identifiable Information.

Your Privacy
Lydian AI follows all applicable legal requirements to protect your privacy. Lydian AI’s Privacy Policy is a statement of its data collection practices, how Lydian AI may share Your information, and how You can limit Lydian AI’s sharing of your information in certain respects. Lydian AI utilizes the personal data You provide in a way that is consistent with this Privacy Policy. If You provide Personally Identifiable Information for a particular reason, Lydian AI may make use of Your Personally Identifiable Information in connection with the reason for which it was provided or as otherwise permitted herein. For example, Your past purchase and subscription history may be used to suggest additional products or services to You. Lydian AI may use Your Personally Identifiable Information to offer access to, and monitor Your use of GhostWrite and its functionality. Lydian AI may also utilize your Personally Identifiable Information and Non-Personal Information gathered through GhostWrite and Lydian AI’s partners and vendors to assist Lydian AI and its partners and vendors with improving the functionality and features of GhostWrite, to better understand and serve You and other users, and to monitor Your compliance with the terms and conditions of the Agreement. You will see terms in this Privacy Policy that are capitalized. These terms have meanings specified in the Definitions section above or in the Agreement.

Personally Identifiable Information Collected

Generally, You control the amount and type of information you provide to Lydian AI when using Our Platform. You must provide Lydian AI with Personally Identifiable Information to create an account and use GhostWrite.

Lydian AI collects Personally Identifiable Information whenever you provide it to Lydian AI, including when You:

Create or update an account;
When you login to your account;
Purchase a product or service from Lydian AI; or
Use GhostWrite to create emails, provided, however, such information is not disclosed to third parties except those Lydian AI uses to assist it in providing GhostWrite and only for those purposes. Such partners and vendors do not retain or disclose this information to others. Aggregated data such as the most common emails users ask GhostWrite to write, trending topics, and user behavior in response to particular emails generated by GhostWrite is not Personally Identifiable Information and may be used and disclosed by Lydian AI for any purpose.

Non-Personal Information Collected

When You use GhostWrite, Lydian AI automatically collects certain Non-Personal Information regarding Your and Your web browser’s and device’s interaction with the Platform. This information may also include how often, when, and what type of purposes You use the App for, and how and when you interact with it. Such information is used for the purposes of Lydian AI better understanding its users, improving and trouble-shooting GhostWrite and the like, and is aggregated and anonymized.

Lydian AI also collects the following data:

Cookies. GhostWrite uses Cookies to identify the areas of GhostWrite that You have visited and other purposes. A “Cookie” is a small piece of data stored on Your computer or device by Your web browser. Lydian AI uses Cookies to personalize what You see on GhostWrite. Most web browsers can be set to disable the use of Cookies. However, if You disable Cookies, You may not be able to use GhostWrite fully or at all. Lydian AI does not place Personally Identifiable Information in Cookies.

Geographical Information. When You use GhostWrite, Lydian AI may use GPS technology (or other similar geolocation technology) to determine Your location in order to determine the city, time zone, or country you are located in and display relevant content accordingly or to prohibit use of GhostWrite in certain locations. Lydian AI will not share Your current or former locations with other users. If You do not want Lydian AI to use Your location for the purposes set forth above, You should turn off the location services on Your device; however, this may not eliminate all location information collection and may prohibit you from using some or all features of GhostWrite.

Traffic Data. Lydian AI automatically receives information from Your web browser or device. This information includes the name of the website, if any, from which You entered GhostWrite, as well as the name of the website to which You’re headed when you leave GhostWrite. This information also includes the IP address of the computer or proxy server that You use to access the Internet, Your Internet provider name, web browser type, type of device, and computer or device operating system and time and activity on GhostWrite.

How We Use Your Information

Lydian AI uses the information it receives from You to:

Operate and provide GhostWrite, in conjunction with partners and vendors;
Provide the services and customer support You request;
Verify Your identity;
Enhance the functionality and features of GhostWrite;
Monitor GhostWrite’s performance and diagnose and resolve issues;
Resolve disputes, prevent potentially prohibited or illegal activities or help law enforcement investigate or prevent crime, enforce the Agreement, and protect Lydian AI’s legal rights or legitimate business interests, or when required by law;
Customize, measure, and improve GhostWrite and Lydian AI’s customer service and advertising and marketing;
Tell You about GhostWrite, other products or services, targeted marketing, updates, and promotional offers based on Your communication preferences;
When You have provided and not withdrawn Your consent to a particular use.

How Lydian AI Shares Your Information

Lydian AI does not resell Your Personally Identifiable Information. However, Lydian AI may disclose Your Personally Identifiable Information to:

Its employees, consultants, partners, and vendors;
Its infrastructure providers;
Protect or defend its legal rights, such as in a lawsuit or arbitration;
Law enforcement and regulatory agencies in connection with any investigation to help prevent or investigate illegal activity or as required by law.

We may also disclose any Non-Personal Information collected to third parties for any business purpose.

Links to Other Websites

GhostWrite may contain or in certain instances generate links to our service providers’ websites or apps or to other websites or apps that are not under Lydian AI’s direct control, including, without limitation, Google / Gmail. Lydian AI has no control over or responsibility for linked websites or apps and provides these links solely for Your convenience and information. You access such linked websites and apps at Your own risk. These websites and apps are not subject to this Privacy Policy and have their own policies regarding privacy. You should check the privacy policies, if any, of those individual websites and apps to see how the operators of those third-party websites will utilize Your information.

Payments

Lydian AI uses third-party services for payment processing (payment processors). Lydian AI will not store or collect your payment card or bank account details. Such information is provided directly to Lydian’s third-party payment processors whose use of Your Personally Identifiable Information is governed by their respective privacy policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Do Not Track Disclosures

Your browser settings may allow You to automatically transmit a “Do Not Track” signal to online services You visit. Note, however, there is no industry consensus as to what website and app operators should do with regard to these signals. Lydian AI does not monitor or take action with respect to “Do Not Track” signals.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. Lydian AI does not specifically market to children under the age of 13 years old, and does not accept users under the age of majority in the jurisdiction in which they reside.

Security

Lydian AI securely protects your Personally Identifiable Information from unauthorized access. Lydian AI takes measures in accordance with industry standards to protect Your Personally Identifiable Information from any alterations, accidental or unlawful destruction, or theft. But You should also be aware that when information is transmitted over the Internet, transmissions are subject to a certain amount of risk, as is data stored at rest, and therefore Lydian AI cannot guarantee You that Your Personally Identifiable Information will never be compromised.

Right to Opt Out

Please note that after You register for a GhostWrite account, subscribe to GhostWrite or Lydian AI emails or text messages, enter a contest or sweepstakes, or contact Lydian AI for any purpose, You may receive emails, text messages, and/or app notifications from Lydian AU or third parties on Lydian AI’s behalf informing You of products and services, promotions, suggestions based on Your Platform usage patterns, etc. You may opt out of receiving such communications from Lydian AI, third parties, or both, by contacting Lydian AI by emailing us at will@lydian.ai, or adjusting the settings in Your account after logging in.

Retention of Information

Lydian AI retains Personally Identifiable Information for as long as you are a registered user of the GhostWrite in order to meet its contractual obligations to You, and for such longer period as may be in Lydian AI’s legitimate business interests, as well as to comply with its legal obligations. Lydian AI may also retain Non -Personal Information indefinitely in its discretion.

Your California Privacy Rights

Shine the Light

Under California’s “Shine the Light” law, California residents who provide personal information when obtaining products or services for personal, family, or household use are entitled to request and obtain from Lydian AI, once each calendar year, information about the customer information Lydian AI shared, if any, with other businesses for its direct marketing uses. If applicable, this information includes the categories of customer information and the names and addresses of those businesses with which Lydian AI shared Your information for the immediately preceding calendar year.

To obtain this information, please submit a request to at will@lydian.ai with “Request for California Privacy Information” in the subject line and in the body of the message. Lydian AI will provide the requested information to You at Your e-mail address. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only required information will be included in the response.

Right to Delete

California residents who desire that Lydian AI delete all of Your Personally Identifiable Information it has on file may submit a request to will@lydian.ai with “California Request to Delete” in the subject line and in the body of the message. Lydian AI will contact You to verify your identity and let you know what personal information it has that it can erase and any that is subject to an exception to your right to request deletion of Your Personally Identifiable Information. If Lydian AI is unable to verify Your identity, Lydian AI may deny Your request. If Lydian AI denies Your request, Lydian AI will explain the reason for the denial in its response. Please note that applicable law permits Lydian AI to retain certain information even if You request its deletion.

Eraser Button

Under California’s “Eraser Button” law, California residents under age 18 who have registered to use the Platform may request removal of any content they have posted. To make a request, email Lydian AI at will@lydian.ai.

California Youth

If You are a California resident and Lydian AI knows You are under 16 years of age, Lydian AI will not sell Your Personally Identifiable Information unless: (i) You are 13 years of age or more and have provided opt-in consent and confirmed that choice, or (ii) You are under 13 years of age and Your parent or guardian has provided affirmative authorization of that sale. If You or Your parent or guardian has provided opt-in consent, You can change your mind at any time by emailing us at will@lydian.ai.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment from Lydian AI for exercising any of Your rights.

Authorized Agent

You may designate an authorized agent to submit requests on Your behalf to Lydian AI. However, Lydian AI will require written proof of the agent’s permission to do so and verify Your identity directly.

Financial Incentives

Financial incentives are programs, benefits, or other offerings, including payments to consumers as compensation, for the disclosure, deletion, or sale of personal information about them. Lydian AI does not offer any financial incentives to You or any other users at this time.

Your Nevada Privacy Rights

Under Nevada’s Security and Privacy of Personal Information Act, NRS Chapter 603A (the “Nevada Privacy Law”), Nevada residents who provide Nevada Personal Information when seeking or acquiring products or services for personal, family, or household use are entitled to request that Lydian AI not sell their personal information. Lydian AI’s notices and disclosures under the Nevada Privacy Law are made above in this Privacy Policy.

Covered Information

For purposes of Nevada’s Privacy Law and this Privacy Policy, Nevada Personal Information means a Nevada resident’s: (1) first and last name; (2) home or other physical address that includes the name of a street and the name of a city or town; (3) email address; (4) telephone number; (5) social security number; (6) an identifier that allows You to be contacted either physically or online; and (7) any other information concerning You with an identifier in a form that makes the information personally identifiable.

Right to Opt Out

Nevada residents may instruct Lydian AI not to sell their Nevada Personal Information at any time. You may submit a request to opt out by emailing us at will@lydian.ai. In the request, please specify that You are a Nevada resident and which right or rights You are seeking to exercise, along with the scope of the request. Lydian AI will confirm receipt of Your request within 60 days. Lydian AI may require specific information from You to help us verify Your identity and process Your request. If Lydian AI is unable to verify Your identity, Lydian AI may deny Your request. If Lydian AI denies Your request, Lydian AI will explain the reason for the denial in its response.

Lydian AI may need to introduce periodic changes to this Privacy Policy. In the event of such changes, You will be informed of the specific changes to the Privacy Policy as provided in Section 17 of the Agreement.
